According to Quran one of the main purposes of the prophets was that the persons and groups consider the rights of each other and when differing on a matter do not fall in disparate and try to accept the judgment of the law which comes from equity and justice. Holy Quran, as the last Sacred Book from the heaven, has been emphasizing that it's most important status should be the same as what today we can see in "constitution" and this place is for it to judge between the people and to protect their fundamental rights. The Holy Prophet of Islam, Muhammad (PBUH) when traveled to Medina established a kind of City-state and founded the base of constitution of this civil society in the form of what is named "Sahife al-nabi". The present essay deals with first: just law and the place it has in Quran and in the injunctions of the prophets and second: different aspects of Sahife al-nabi and then concludes with the fact that Muhammad (PBUH) was to establish a kind of government which was somehow a pioneer ruling and that kind of ruling had many features of a modern state that modern human beings are in need of that.  }, keywords = {Constitution,fundamental rights,religious sovereignty,sovereignty}, title_fa = {صحیفة النّبی(ص)؛ نماد قانون گرایی در حکومت نبوی}, abstract_fa = {چکیده رعایت حقوق اساسی افراد و گروهها از شاخصه‌های جامعه مدنی است. مطابق قرآن کریم، یکی از اهداف مهمّ رسالت پیامبران این بوده است که افراد و گروههای انسانی، حقوق همدیگر را به رسمیّت بشناسند و در موارد اختلافی به نزاع و ستیزه روی نیاورند، بلکه در عوض به داوری قانون عدل تن در دهند. قرآن مجید، به عنوان آخرین کتاب آسمانی، تأکید کرده است که مهم‌ترین شأن «کتاب»، همان شأنی است که در عرف امروز به «قانون اساسی» نام بردار است تا در بین مردم به حق داوری کند و پاسدار حقوق اساسی آنها باشد. پیامبر اسلام، وقتی به مدینه آمدند «دولت ـ شهر» مدینه را تشکیل دادند و سنگ بنای حقوق اساسی این جامعه مدنی را در پیمان نامه‌ای بنیان نهادند که به «صحیفة النبی» شهرت یافته است. این مقاله، نخست موضوع قانون عدل و جایگاه آن در قرآن و آموزه‌های انبیاء را به اختصار و به مثابه مقدمه این نوشته، بررسی کرده و سپس به تفصیل به تحلیل ابعاد صدوری و محتوایی صحیفة النّبی پرداخته است و به این نتیجه رسیده است که حاکمیّتی را که پیامبر به دنبال آن بود، صدها سال از زمان خود پیش بوده و بسیاری از ویژگی‌های یک دولت مدرن ـ که امروزه از مطالبات جامعه بشری است ـ را نیز دارا بوده است.}, keywords_fa = {قانون اساسی,حقوق اساسی,حاکمیّت دینی,حکومت نبوی,جامعه مدنی}, url = {https://kq.meybod.ac.ir/article_222.html}, eprint = {https://kq.meybod.ac.ir/article_222_8725046f500825bff03e8f5e1165c5a2.pdf} }
