Some of them draw upon the criminal biology and adopt a radical approach to claim that biological fatalism is involved in criminal behaviors. Some others adopt a mild approach based on social biology and consider a criminal as a person with options but deviated tendencies who commits crimes under the impact of environmental factors. A delve into Nahj ol-Balagheh indicates that, several centuries before the advent of scientific criminology, Imam Ali (pbuh) had thoroughly discussed the etiology of crimes. He identified a set of crime-inducing factors and offered the most effective and practical ways of detecting the roots of crimes. Through library work and content analysis, this study seeks to investigate the factors that lead to crimes from Imam Ali’s perspective. As the results show, crimes stem from different grounds; when the grounds are prepared, crimes occur inevitably. According to Nahj ol-Balagheh, there are biological, psychological and social factors to predispose crimes, but man is seen between the two poles of force and option. Thus, a criminal can never claim to be predestined to commit crimes. An analysis of such teachings in the book can provide insights for the introduction of new theories in criminology and better methods to prevent crimes.}, keywords = {Nahj ol-Balagheh,Etiology of crimes,Tendency for crimes,Biological factors,Psychological factors,Social factors}, title_fa = {بازتاب آموزه های نهج البلاغه در جرم شناسی علت شناختی}, abstract_fa = {DOR: https://dorl.net/dor/20.1001.1.22516026.1399.10.23.12.7 نگاه‌‌ علت­شناسانه به رفتار مجرمانه، به دنبال شناسایی عوامل جرم­زا مورد توجه جرم­شناسان قرار گرفته است؛ برخی با رویکردی افراطی و به تبعیت از زیست­شناسی­جنایی، قائل به جبرگرایی زیستی در رفتار مجرمانه بوده و برخی با رویکردی تعادل­گرا با الهام از زیست­شناسیِ­اجتماعی، بزهکار را موجودی مختار اما با گرایش­های منحرفانه قلمداد کرده‌اند که تحت تأثیر شرایط محیطی، مرتکب جرم می­شود. بررسی مضامین مندرج در نهج‌البلاغه نشان می‌دهد قرن­ها پیش از شکل­گیری جرم­شناسیِ علمی، سبب‌شناسی رفتار مجرمانه به صورت همه­جانبه مورد توجه امیرالمؤمنین(ع) قرار داشته ‌است؛ به گونه­ای که مجموعه­ای از عوامل جرم­زا را شناسایی و مفیدترین و کاربردی­ترین راهکارهای ریشه­یابی رفتارهای مجرمانه را ارائه­کرده­است. در این مقاله، با استفاده از روش اسنادی و تحلیل محتوا، عوامل جرم­زا از دیدگاه حضرت علی(ع) مورد بررسی قرار‌ گرفته ­است. یافته‌های تحقیق حاکی از آن است که جرم، معلول عوامل مختلفی است؛ چنانچه علت یا علل آن پدید آید، جرم ناخواسته رخ ­می­دهد. همچنین آموزه­های نهج­البلاغه هر چند بر نقش عوامل زیستی، روانی و اجتماعی به عنوان عوامل زمینه­ساز جرم تأکید می­کند؛ اما همواره انسان را در بینابین وادی جبر و اختیار تفسیر کرده و به هیچ روی از بزهکار به عنوان موجود اسیر سرنوشت محتوم خویش، یاد نکرده است. تحلیل این نگرش­ها می­تواند در ارائه نظریات جدید جرم­شناسی و راهکارهای نوین کاربردی پیشگیری از جرایم، مفید و مؤثر باشد.}, keywords_fa = {نهج‌البلاغه,علت شناسی جنایی,تمایل مجرمانه,علل زیستی,علل روانی,علل اجتماعی}, url = {https://kq.meybod.ac.ir/article_2036.html}, eprint = {https://kq.meybod.ac.ir/article_2036_e23d375e07de44ed1fcef76799cc3be5.pdf} }
